I understand and agree that in participating in any dance class, workshop, rehearsal or performance, there is a possibility of physical injury or death. I voluntarily agree, therefore, to assume all risks and responsibility for any such injury or accident, which might occur to me during any of Polemic Dance & Fitness Studio, LLC, classes, rehearsals, performances, or activities. I also exempt, release, and indemnify Polemic Dance & Fitness Studio, LLC, its owners, agents, volunteers, assistants, instructors, guest artists, faculty members, and/or students from any and all liability claims, demands, or causes of action whatsoever from any damages, economical or emotional loss, illness, injury, death to me or my property which may arise out of or in connection with participation in or observation of any classes or activities conducted by Polemic Dance & Fitness Studio, LLC, including traveling to and from related events or activities. I further hereby voluntarily agree to waive my rights and that of my heirs and assigns to hold Polemic Dance & Fitness Studio, LLC, its owners, agents, volunteers, assistants, instructors, guest artists, faculty members, and/or students liable for such damage, loss, injury, or death. I understand that I should be aware of my physical limitations and agree not to exceed them.
In the event that any provision contained within this Release of Liability shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect, so long as the clause severed does not affect the intent of the parties. If a court should find that any provision of this agreement to be invalid or unenforceable, but that by limiting said provision it would become valid and enforceable, then said provision shall be deemed to be written, construed and enforced as so limited.
I AM VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED ACTIVITY AND I AM PARTICIPATING IN THE ACTIVITY ENTIRELY AT MY OWN RISK. I AM AWARE OF THE RISKS ASSOCIATED WITH TRAVELING TO AND FROM AS WELL AS PARTICIPATING IN THIS ACTIVITY, WHICH MAY INCLUDE, BUT ARE NOT LIMITED TO, PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, AND DEATH. I UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM MY OWN OR OTHERS’ NEGLIGENCE, CONDITIONS RELATED TO TRAVEL, OR THE CONDITION OF THE ACTIVITY LOCATION(S). NONETHELESS, I ASSUME ALL RELATED RISKS, BOTH KNOWN OR UNKNOWN TO ME, OF MY PARTICIPATION IN THIS ACTIVITY, INCLUDING TRAVEL TO, FROM AND DURING THIS ACTIVITY.
I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS “WAIVER AND RELEASE” AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I EXPRESSLY AGREE TO RELEASE AND DISCHARGE POLEMIC DANCE & FITNESS STUDIO, LLC, AND ALL OF ITS AFFILIATES, MANAGERS, MEMBERS, AGENTS, ATTORNEYS, STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNS, FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION AND I AGREE TO VOLUNTARILY GIVE UP OR WAIVE ANY RIGHT THAT I OTHERWISE HAVE TO BRING A LEGAL ACTION AGAINST POLEMIC DANCE & FITNESS STUDIO, LLC, FOR PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE.
ASSUMPTION OF RISK AND WAIVER OF LIABILITY RELATING TO COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
Polemic Dance & Fitness Studio, LLC, has put in place preventative measures to reduce the spread of COVID-19; however, Polemic Dance & Fitness Studio, LLC, cannot guarantee that you will not become infected with COVID-19. Further, attending classes or other activities at Polemic Dance & Fitness Studio, LLC, could increase your risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by participating in or observing activities at Polemic Dance & Fitness Studio, LLC, and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Polemic Dance & Fitness Studio, LLC, may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Polemic Dance & Fitness Studio, LLC, employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with attendance at Polemic Dance & Fitness Studio, LLC. I hereby release, covenant not to sue, discharge, and hold harmless Polemic Dance & Fitness Studio, LLC, its owners, members, instructors, volunteers, employees, agents, and representatives, of and from all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of Polemic Dance & Fitness Studio, LLC, its owners, members, instructors, volunteers, employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Polemic Dance & Fitness Studio, LLC, activity.
BY REGISTERING AND PAYING FOR ANY CLASS, EVENT, PRIVATE LESSON, OR OTHER ACTIVITY THROUGH THIS WEBSITE, YOU ARE AGREEING TO ALL OF THE ABOVE CONDITIONS AND WAIVERS.
